🏛️ Successful Interim Injunction Secured under the New Civil Procedure Rules of 2023
📣 On the 17th of October 2024, Papantoniou & Papantoniou LLC has achieved a successful outcome in securing an interim injunction, prohibiting the respondent from approaching and following the applicants, pursuant to the Law on Protection from Harassment and Stalking of 2021 (114(I)/2021).
🔑 The applicants obtained the interim injunction via an ex-parte application as they have proved the urgency of the matter. Significantly, the application for issuing an interim injunction was made prior to the filing of the claim, as a form of protective measures for the interests of our clients based on article 32 of the Court of Justice Law (14/60). The said provision confers power on the Cyprus’ Courts to grant interim injunctions that may prohibit certain actions or mandate the performance of specific actions, with international effect.
💡 It is of great importance that the new Civil Procedure Rules, which entered into force in September 2023, offer the possibility for an applicant of an interim injunction to file an application before the filing of a claim.
