Papantoniou & Papantoniou LLC recently acted on behalf of a contractor in the successful resolution of a complex construction dispute, which was originally filed before the District Court of Nicosia and involved claims exceeding €1million.
The dispute arose from a large-scale construction project and concerned a number of legal and contractual issues frequently encountered in the construction sector. These included substantial claims for varied and additional works, the wrongful imposition of liquidated damages, and the incorrect assessment of the contractor’s entitlement to extensions of time under the contract.
Our Director, Alexandros A. Papantoniou, provided comprehensive support throughout the dispute resolution process, adopting a proactive and strategically coordinated approach. This involved a thorough review and analysis of the contractual documents, construction records, and project correspondence, as well as the preparation of detailed construction claims.
We structured and presented the contractor’s claims in a manner that highlighted the employer’s failure to issue timely instructions, the late approval of variation orders, and the cumulative impact of project delays for which our client bore no responsibility. Furthermore, we challenged the validity of the liquidated damages imposed and substantiated the contractor’s entitlement to time and financial compensation in accordance with the terms of the contract and applicable legal principles.
Through targeted negotiations and robust legal advocacy, the dispute was ultimately resolved on terms highly favourable to our client, who secured payment for the vast majority of the claims advanced.
This matter illustrates the importance of clear contract administration, timely legal advice, and a strong understanding of the legal framework governing construction projects in Cyprus.
